The structure that works

  1. Subject line stating it is an application for release/unfreezing, the account number, and the bank's reference of the freeze.
  2. Identification — your name, account number, the date you discovered the freeze, and how (failed transaction, branch visit, SMS).
  3. The disputed amount and the balance — state both. The gap between them is the basis for at least a partial release.
  4. Your position — that you are a bona fide account holder / innocent downstream recipient, with a one-line explanation of the credit if you know it.
  5. The legal basis for release — cite the MHA SOP 2026, the 90-day rule if the disputed sum is below Rs. 50,000 (see the 90-day rule), and the proportionality point.
  6. The specific relief sought — full release, or (often more achievable) a lien limited to the disputed amount with the balance released.
  7. Documents enclosed — listed.
  8. A clear request for a written response within a stated time, putting the recipient on notice.

Keep it factual and specific. Avoid emotional language; state dates, amounts and references. Always ask for a written reply — silence in response to a documented written application is itself a ground you can later rely on, whereas an oral refusal leaves no record. Send it through a traceable channel (email with delivery record, or registered post) and keep proof of dispatch.

When the application is enough — and when it isn't

For a low-value, clearly-innocent downstream freeze, a correct application plus one escalation often resolves it. Where the bank and IO ignore repeated applications, or where the disputed sum is large or a court order is involved, the next step is the writ jurisdiction of the High Court — at which point formal representation is appropriate.
